The EU regulatory system for chemicals is going through massive change at the moment. The EU has just finished long and often painful negotiations on REACH, the most fundamental and far reaching change to chemicals legislation of the last 30 years, and globally most countries are looking to implement the GHS, the Globally Harmonised System for Classification and Labelling of Chemicals. There are also a vast array of instruments, national, regional and international, currently in operation that impact on chemicals (e.g. EU Regulations and Directives, OECD and UN programmes). New programmes also seem to be imposed at frighteningly regular intervals.

Existing Legislation
Whilst the focus may be on the recent developments in chemicals legislation, companies still have to meet the existing legislative requirements. This legislation will continue to apply until REACH takes over. The Existing Substances Regulation continues to require community risk assessments on 141 of the most common high volume chemicals and these can lead to recommendations for Community risk management measures including in some cases restrictions and bans. Classification and labelling of both substances and preparations also continues to be required, the effects of which can influence downstream legislation, even after REACH is in force. The effects of both these systems can be far reaching in the supply chain and effective monitoring of the regulatory situation and fast and effective reaction is necessary to avoid costs and loss of market share. Requirements for the notification of new substances and the production of safety data sheets also continue.
